One of the provisions in a compromise agreement that sometimes causes a lot of negotiations is the following:-
The Employer agrees that, subject to its legal or regulatory obligations to third parties, it shall not make or publish any derogatory or disparaging statement concerning the Employee or do anything which is intended to or which might be expected to damage or lower the Employee’s reputation.
In a number of cases, Employers have refused to agree to such a wide provision.
