As employment law solicitors, we regularly advise clients on employee rights in relation to redundancy, particularly around holiday entitlement and whether payment in lieu of notice is taxable (PILON). When it comes to compromise agreements, it is always advisable to clearly set out any untaken accrued holidays and PILON and to show these separately.

Your notice period does not cover holiday pay. Therefore, you should be paid your holiday pay.

I shall be taking voluntary redundancy on 31st December this year, my employer is proposing to pay me 12 weeks notice from that date when I shall not be needed to attend work. Should that 12 week notice payment include an allowance for holiday pay?
